Midtre Namdal Avfallsselskap shall open a landfill site for easily polluted matter and shall, thus, procure an excavator for use at the landfill site. This shall have belts and be equipped with i.a. normal excavator drawers and pu shovels with rotortilt. It is here chosen to purchase a newer used machine in the size 25-30 tons. Tenderers who believe that the contracting authority ́s implementation of the competition are not in accordance with the procurement regulations, can appeal to the contracting authority. Appeals shall be presented in writing to the contracting authority. The contracting authority will process the complaint as soon as possible. After notification of the award decision, a waiting period will be set before the contract is signed. The waiting period will be in the award of contract and it gives tenderers the opportunity to assess the decision and possibly submit appeals. For procurements in accordance with part III of the regulations, the waiting period will be minimum 10 days from the day after the notification has been sent. Tenderers can also bring the matter to the Appeals Board for public procurements (KOFA) or the law courts. Appeals are not required to be filed first for the contracting authority. The contracting authority can make decisions until the contract is signed if an error is discovered in the process.
